1. ACCEPTANCE OF TERMS

1.1 Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between You ("Customer," "User") and Accessify AI ("Provider," "We," "Us"), an entity organized under the laws of India.

By connecting a repository, accessing, or using the Accessify AI platform ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1.2 Authority

If you use the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. SERVICE DESCRIPTION

2.1 Scope of Service

Accessify AI is a SaaS platform designed to assist developers in identifying accessibility issues. Features include:

• Automated scanning of websites and code repositories (e.g., GitHub).
• Detection of violations aligned with WCAG 2.1/2.2 and EN 301 549 (EU Standards).
• AI-generated remediation recommendations.
• Dashboards for tracking accessibility posture.

2.2 Service Limitations

Accessify AI provides tools to assist with compliance but does not guarantee it. You acknowledge that:

• The Service does not provide legal advice or legal certifications.
• Compliance with the Americans with Disabilities Act (ADA), European Accessibility Act (EAA), or other laws is your sole responsibility.
• Automated scans cannot detect 100% of accessibility errors; manual testing is required.

2.3 AI Disclaimer

Our Service utilizes Artificial Intelligence (AI) and Large Language Models (LLMs) to generate remediation suggestions. You acknowledge that:

• AI outputs may be inaccurate, incomplete, or produce "hallucinations."
• Human Review Required: You must review and test all AI-generated code before deploying it to production. Accessify AI is not liable for bugs, security vulnerabilities, or breaks in functionality caused by auto-generated code.

3. SUBSCRIPTION & PAYMENTS

3.1 Pricing

Plans and pricing are displayed on our website. We reserve the right to modify pricing with reasonable notice.

3.2 Payment Processing

Payments are processed via PayPal. By subscribing, you authorize Accessify AI to charge your account on a recurring basis.

3.3 Taxes

Fees are exclusive of taxes.

• India: GST will be added where applicable.
• EU Customers: You are responsible for applicable VAT. If you provide a valid VAT ID, the Reverse Charge Mechanism will apply. If no VAT ID is provided, we may charge the applicable VAT rate of your country of residence.

3.4 Refunds & Right of Withdrawal

30-Day Money-Back Guarantee: You may request a full refund within 30 days of your initial subscription if you are dissatisfied.

EU Right of Withdrawal Waiver: By using the Service (starting a scan), you acknowledge that the service has commenced and you waive your statutory right of withdrawal, relying instead on our 30-Day Money-Back Guarantee.

4. ACCEPTABLE USE & DATA SECURITY

4.1 Prohibited Conduct

You may not:

• Scan repositories or websites you do not own or have explicit permission to test.
• Reverse engineer the Service.
• Use the Service to train competing AI models.

4.2 Authorization

You represent that you have full authority to scan all assets submitted to the Service.

5. SERVICE AVAILABILITY (BEST EFFORTS)

Accessify AI is provided on a "commercially reasonable best-efforts" basis. We do not guarantee continuous uptime or error-free operation. We are not responsible for outages caused by third-party providers (e.g., GitHub, PayPal, Cloud Providers).

6. INTELLECTUAL PROPERTY

We retain all rights to the Service, software, and algorithms. You retain ownership of your websites, repositories, and the specific reports generated for you.

7. DATA PROTECTION (GDPR)

Your use of the Service is governed by our Privacy Policy. To the extent we process Personal Data of EU subjects (e.g., names in git commit logs) on your behalf, we act as the Data Processor and you act as the Data Controller under the GDPR.

8. DISCLAIMERS & LIMITATION OF LIABILITY

8.1 No Warranty

THE SERVICE IS PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

8.3 EU Specific Liability

For customers in the EU: Nothing in these Terms excludes our liability for death/personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. INDEMNIFICATION

You agree to indemnify Accessify AI from claims arising from your use of the Service, your violation of these Terms, or your scanning of unauthorized assets.

10. GOVERNING LAW

These Terms are governed by the laws of India. Courts in Chennai shall have exclusive jurisdiction.
